2. Type of service

Accessing the WEBSITE is free of charge, although the procurement of goods or services through the WEBSITE is subject to a payment.

The main objective of this WEBSITE is to provide English teachers in Spain with an online platform where they can access all the teacher resources of the textbooks developed by the COMPANY. In concordance with this objective, the use of this platform is exclusive to English teachers in Spanish teaching centres.

3. USER Liability

The user undertakes not to use the WEBSITE or any information provided in order to carry out activities against law, morality or public order. The user also undertakes to use it under the terms and conditions established by the COMPANY.

The COMPANY will not be responsible of any damages that may result from any opinion, content or activity conducted by the user, which are out of its control.

By registering on this WEBSITE, the USER undertakes to store the passwords and the identification codes and, in case the USER loses them, to report in the shortest time to the COMPANY. While there is no such communication, the COMPANY is relieved of responsibility of any misuse by unauthorized third parties.

Given that the access to this WEBSITE also entails the use of a unique code for the teaching centre common to all USERS of the same centre (School MasterCode), which is strictly confidential, the USER undertakes not to provide such code to anyone outside of the teaching staff at the centre, and to immediately report to the COMPANY in the event of its loss, unauthorised access or theft.

The user may at any time close his or her account on this WEBSITE, through the section ‘My profile’.

4. Disabling of the USER’s account

The WEBSITE will at any time be able to disable or deactivate the USER’s account(s) when the conditions established in these Terms of Use are not followed, to the COMPANY’s sole discretion. Likewise, the WEBSITE will also be able to disable any accounts where it is suspected that the USER might be involved in illegal or fraudulent activity related to the services provided by the WEBSITE.

Specifically, The WEBSITE will disable the account(s) of any USER who is not part of the teaching staff of the centre he/she is registered in, or of any USER who has provided the School MasterCode to anyone outside of the teaching staff of their centre. For that purpose, the COMPANY may at any time contact the teaching centre to obtain an updated list of the teaching staff and disable the account(s) of any USER not included in said list.

The disabling of the USER’s account(s) will not imply the automatic removal of any personal data that the COMPANY stores on their databases. To that effect, the user who wishes to have his/her personal data removed from said databases will be able to exercise his/her rights of access, rectification, cancellation and opposition in the manner established in the Privacy Policy of this WEBSITE.

5. COMPANY liability

The COMPANY will not be responsible of any error in accessing the WEBSITE or its contents, although all necessary measures will be taken in order to avoid them.

The COMPANY reserves the right to suspend temporally and without prior notice, the access to the WEBSITE due to maintenance, repair, updating or improvement.

6. Intellectual property

All contents of the WEBSITE (including, but not limited to, databases, images, pictures, graphics, text, audio, video and software) are owned by the COMPANY and they are protected by the national and international intellectual and industrial laws. All rights reserved.

Also, the domain name, marks, signs and logos displayed on the Site are owned by the company.

All text, drawings, graphics, videos or audio that currently or in the future might be on the WEBSITE are property of the COMPANY, and may not be subsequently modified, copied, altered, reproduced (totally or partially), adapted or translated by the USER or any third party without the express authorization of the COMPANY.

Unauthorized use of the information contained in this WEBSITE, and any damage on intellectual property rights, will cause legal responsibilities.

7. Hyperlinks

The creation of any hyperlink from a foreign WEBSITE to any of the pages of the COMPANY WEBSITE is subject to the following conditions:

  • Total or partial reproduction of the services which are offered by the COMPANY is not allowed.
  • Any false, inaccurate or incorrect statement about the WEBSITE of the COMPANY is not allowed.
  • Under no circumstances, the COMPANY will be responsible for the contents, information, demonstrations, opinions or services made available to the public on the WEBSITE from which a hyperlink is established to this WEBSITE.
  • Any hyperlink will be made to the main home page of the WEBSITE.

The hyperlinks found on the WEBSITE have previously been authorized by the owners of the web sites linked. The company is not responsible of any activities against law, morality or public order made by users on such linked sites.

8. Validity

The terms and conditions of this WEBSITE are established for an unlimited period. The COMPANY reserves the unilateral right to modify the conditions of access to them, as well as their content.

9. Nullity and inefficiency of the clauses

If any clause in these terms and conditions were declared fully or partially invalid or either ineffective, such invalidity will affect only that clause or part of it, not the rest of the terms and conditions.

10. Applicable Law

The provision of services through this WEBSITE and its legal notice are governed by the Spanish law. The parties expressly agree to submit to the jurisdiction of the Courts and Tribunals of Madrid, avoiding any other jurisdiction that may apply.
